How employment disputes are resolved
Many workplace disputes in Jamaica are first referred to the Ministry of Labour and Social Security for conciliation. If they are not resolved, certain disputes can be referred to the Industrial Disputes Tribunal under the Labour Relations and Industrial Disputes Act, while claims such as breach of contract can be taken to court. Redundancy entitlements are governed by the Employment (Termination and Redundancy Payments) Act. We advise on the right route and represent you at each stage.

What can I do if I was unfairly dismissed in Jamaica?
You may be able to bring a complaint through the Ministry of Labour and Social Security, which can lead to a referral to the Industrial Disputes Tribunal, or a claim in court depending on the circumstances. Remedies can include compensation or reinstatement. Take advice quickly.
Am I entitled to redundancy pay?
Employees with the qualifying period of continuous service who are made redundant are generally entitled to redundancy payments under the Employment (Termination and Redundancy Payments) Act. The amount depends on length of service and pay.
Should I sign a settlement agreement from my employer?
Have it reviewed first. Settlement agreements usually stop you bringing claims later, so you should understand what you are giving up and whether the offer is fair.
